Dear Union Members,
I am writing to provide you with an important update regarding the bankruptcy of 13994929 Canada Inc. and to inform you of the steps our Union is taking to protect your rights and interests during this challenging time.
The default of 13994929 Canada Inc. has resulted in significant uncertainty and concern for UFCW members. There are two main components to bankruptcy, and I’d like to take this opportunity to outline them with you; first, there is the matter of your continued employment, seniority, and rights under the collective agreement. Secondly, are lost wages, vacation pay, and potential notice of termination or severance pay.
I want to assure you of UFCW’s dedication to fighting for the continuation of your collective agreement and your seniority. Neptune has made this particularly difficult for all parties involved, as no bill 7 information exists to share with the incoming security companies. To allow us to assist you in the transition better and help ensure you get credit for your many years of employment, fill out this FORM.
If you are working on a site with no new security company taking over, the Union insists you halt work immediately; you will not continue to get paid and have no insurance or legal protection. The former Neptune Client is not responsible for protecting you in the event of an injury or lawsuit.
The Union’s legal team has engaged with the bankruptcy receiver to ensure the process for the Federal government’s Wage Earners Protection Plan (WEPP) will be as smooth as possible for you. The WEPP will assist eligible employees financially in cases like Neptune’s insolvency. UFCW is working tirelessly to ensure all eligible members receive the support they deserve.
The Union has also hired a specialty accounting firm to compile and submit claims for our members. The first step that you must take is to fill out this FORM. YOU MUST COMPLETE it with as much detail as possible.
If you run out of space, upload everything you can and email the rest to [email protected] with “Neptune – your full name” in the subject line.
We will give all the completed information to the bankruptcy trustees, who will issue you a proof of claim; if your “proof of claim” is less than the amount owed (calculated by the accounting firm using the information submitted), you may be able to apply for the federal Wage Earners Protection Plan (WEPP) and compensated for the rest, up to a maximum of $8278.83.
In the meantime, I encourage you to stay informed and contact your Union Representatives with any questions or concerns. We are here to support you and provide guidance during these difficult times.
Unfortunately, while we know what steps we need to take, the Union cannot provide a timeline on how long it will take. The lawyers clarified that the faster and more accurate your report information is, the faster you will get proof of claim from the bankruptcy trustee.
Your resilience as UFCW members is genuinely commendable. Together, we will navigate this situation and emerge stronger on the other side. as we protect your rights. We are your voice at work.
